Terms & Conditions

  

These Terms & Conditions govern all works carried out by Cloughjordan Building & Renovation (“the Contractor”) for the Client. 

1. Definitions 

1.1 Client: The person or entity engaging the contractor.

1.2 Works: All labour, materials, and services described in the quotation.

1.3 Site: The location where the works are carried out.

2. Quotation & Scope 

2.1 Quotations are valid for 30 days unless stated otherwise.

2.2 Only works expressly listed are included. Additional works are treated as variations.

2.3 All drawings, measurements, and information provided by the Client are assumed accurate.

3. Variations 

3.1 Variations must be agreed in writing.

3.2 Variations may affect price and completion time.

3.3 Urgent works required for safety or compliance may proceed and be charged accordingly.

4. Payments 

4.1 Terms of Payment are as agreed upon in the estimate.

4.2 Late payments may incur penalties in accordance with the European Communities (Late Payment in Commercial Transactions) Regulations 2012.

4.3 Final payment is due upon practical completion.
4.4 Late payments may incur interest in line with the European Communities (Late Payment in Commercial Transactions) Regulations 2012.

4.5 The Contractor reserves the right to suspend works where payments are overdue.

5. Delays 

5.1 The Contractor is not liable for delays beyond its control, including weather, supplier delays, inspections, or Client instructions.

5.2 Completion dates are estimates unless confirmed in writing.

6. Client Responsibilities & Site Conditions 

6.1 Provide safe and unrestricted access to the Site and necessary utilities.

6.2 Obtain all required permissions and approvals unless agreed otherwise.

6.3 The Client is responsible for removing, protecting, or securing all personal belongings, furniture, materials, and effects within or adjacent to the work area.

6.4 The Contractor shall not be liable for loss of or damage to any property, materials, or personal effects left in the work area under any circumstances.

6.5 The Contractor is not responsible for relocating any items within the work area. Any relocation, if required, shall betreated as a separate service and may incur additional charges.

7. Materials & Ownership 

7.1 Materials remain the property of the Contractor until paid for in full.

7.2 Where specified materials become unavailable, suitable alternatives of equal quality may be used.

8. Quality & Defects 

8.1 Works will be carried out with reasonable skill and care.

8.2 Defects due to workmanship reported within 3 months will be remedied.

8.3 Normal wear and tear, misuse, and third-party works are excluded.

9. Health & Safety 

9.1 The Contractor complies with Irish health and safety legislation.

9.2 The Client must disclose known hazards, including asbestos.

10. Insurance & Liability 

10.1 The Contractor maintains appropriate public liability insurance.

10.2 Liability is limited to the contract value except where prohibited by law.

10.3 No liability is accepted for indirect or consequential losses.

11. Termination 

11.1 Either party may terminate for material breach with 7 days’ written notice.

11.2 The Client shall pay for works completed and materials ordered up to termination.

12. Disputes 

12.1 Disputes shall be resolved amicably in the first instance, and by mediation if required.

13. Governing Law & Tax 

13.1 These Terms are governed by the laws of Ireland.

13.2 Where applicable, Relevant Contracts Tax (RCT) shall be operated in accordance with Revenue requirements

15. Entire Agreement

15.1 These Terms & Conditions, together with the quotation and agreed variations, constitute the entire agreement.
